By using this form to request a copy of this program you are agreeing to MGTV’s copyright and licensing information.
The video and audio signals of MGTV (Michigan Government Television Inc.-MGTV) are protected by U.S. copyright and international treaties and may not be copied without the express permission of MGTV, which reserves all rights. These video and audio signals will be referred to as ‘Content’. Re-use of any of MGTV’s Content for any purpose may be granted on a case-by-case basis provided the Content is not modified in any way, all copyright and other notices on any copy are retained, and permission is granted by MGTV.
Use or re-use of MGTV’s signal or programming Content for any commercial or political purpose is strictly prohibited.
MGTV will sell DVD (or other formats) copies of its Content to the general public, sponsoring organizations of televised events, and others. No commercial or political use of this material will be allowed.
1. License and Access
Subject to the terms of this User Agreement, MGTV grants you a limited, revocable, nontransferable, non-exclusive license to access and view our Content, provided that unless otherwise expressly provided herein, no portion of our Content may be recorded, reproduced, reprinted, republished, modified, duplicated, copied, sold, resold, distributed, redistributed, publicly displayed or publicly performed in any form without the express written permission of MGTV.
Simultaneous streaming or retransmission of the MGTV networks’ video coverage of any event live or recorded, will not be posted or aired under any circumstances without a license.
2. Explicit Prohibition for Political or Commercial Use
You acknowledge and agree that you will not use our Content for commercial purposes or for political purposes. For this User Agreement, our Content is used for political purposes if any of the following apply:
a. The Content is disseminated in any way for the purpose of influencing the election or nomination for election of any individual to federal, state or local office, for the purpose of influencing the recall from or retention in office of an individual holding a federal, state or local office, for the purpose of payment of expenses incurred as a result of a recount at an election, or for the purpose of influencing a particular vote at a referendum.
b. The Content is disseminated in any way that expressly advocates the election, defeat, recall or retention of a clearly identified candidate or a particular vote at a referendum.
c. The Content is disseminated in any way for the purpose of influencing an endorsement or nomination to be made at a convention of political party members or supporters concerning, in whole or in part, any campaign for federal or state law, or an agent or dependent of such a person.
3. Legal Compliance
You agree to comply with all applicable federal and state laws and regulations in connection with this User Agreement.
4. School Use
MGTV hereby grants educators this license containing the right to tape any MGTV- produced program without receiving prior permission from MGTV, so long as the copying is for in-classroom use and not for sale, distribution, or any political or commercial purpose. The terms of this license constitute a liberal copyright policy that allows educators to record MGTV-produced programs (at school or at home) for later use. Such programs may be retained in perpetuity for future in-classroom use. No license fee shall be due for using MGTV as an educational resource so long as such use is made in accordance with the terms of this license.
MGTV grants to educators free and unlimited use of its signal and the rights to retain recordings in perpetuity as long as such use is for instructional purposes.
MGTV makes our Content available through (I) broadcasting signals or a direct signal, and (II) our website (the Site). The term broadcasting as used herein, means in the general sense of transmission by any means possible, including via cable or air, and shall not be limited by any federal or state legal definitions.
MGTV video and audio signal may be used by bona fide news broadcasters without charge except for certain direct costs such as tape duplication. The signal provided to television broadcasters shall include on-screen credit to MGTV throughout the footage. Use of audio files, shall be granted if the broadcaster makes oral credit attribution to MGTV.
In addition to and subject to the limitations of the license, users who are individuals or news organizations (Bona Fide News Gatherers) are authorized to record, reproduce, edit, transmit and publicly display our Content for news gathering purposes, provided such Users comply with all other provisions of this agreement, keep all copyright, trademark, and other ownership notices in the Content intact. Spot News Gathering shall be defined as timely, editorial information for public consumption relating to daily state government events or actions and does not include use in opinion pieces or commentary. Such Users rights to record, reproduce, edit, transmit, publicly display and perform are limited to the purposes expressly described herein, and such Users do not have the right to reprint, republish, modify, sell, resell, distribute or redistribute our Legislative Content in any form without the express written permission of MGTV. Full length coverage by Bona Fide News Gatherers of individual event state proceedings will be permitted only with prior written approval from MGTV. No use under this section shall in any way distort or misrepresent state government proceedings.
6. Commercial Use
MGTV does NOT permit unlicensed commercial use of any of its video programming (including coverage of local, state and federal government events) whether or not MGTV is attributed as the source of the video. Under this policy a license is required to use MGTV video for:
Documentaries, films, television programs, online use
Distribution by broadcast, cable, satellite or online
Corporate, trade or professional use.
Compilation DVDs and the like.
Any use that relies substantially on MGTV video to generate revenue.
Limitation and Release of Liability
You hereby release MGTV (and our employees, directors, officers, donors, agents, users, parent, subsidiaries, affiliates and other partners) from any loss, cost, claim, damage, liability and/or expense, of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, including reasonable attorney’s fees arising out of or in any way connected with our Content or Site or resulting from your use of our Content or our Site in whole or in part, any campaign for federal, state or local office.
Except as otherwise provided in this Section 15, you agree to indemnify, defend and hold MGTV and (as applicable) our employees, directors, officers, donors, agents, users, parent, subsidiaries, affiliates and other partners, harmless from and against any loss, cost, claim, damage, liability and/or expense, of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, including reasonable attorney’s fees arising out of or in any way connected with our Content or Site, resulting from your use of our Content or our Site, your access to our Site, your breach of this User Agreement or violation of any law or third party’s rights.
